By Associated Press DENVER - Attorneys for the woman accusing Kobe Bryant of rape say they should be allowed to ask the NBA star about his sexual history as part of her civil lawsuit, according to court documents prepared Thursday.
Granting Bryant's request to bar such questions during an upcoming deposition would be special treatment because Bryant's defense attorneys have made it clear they intend to use Katelyn Faber's sexual history against her, Faber's lawyers argue in the documents.
L. Lin Wood, one of Faber's attorneys, provided the documents to The Associated Press on Thursday. He said they would be filed Monday as part of Faber's civil lawsuit against Bryant, after weather delayed their delivery Thursday to U.S. District Court in Denver.
The law firm representing Bryant closed early Thursday for the holiday. Phone messages left for his lawyers were not returned.
The filing prepared Thursday argues that Bryant's sexual history is "plainly relevant" to the civil lawsuit.
"Mr. Bryant cannot, in good faith, claim that Faber's sexual history is relevant to her claim that he sexually assaulted and raped her, but evidence of his own is not," the filing says. Copyright 2004, Rocky Mountain News. All Rights Reserved. |
